Welcome to Sugardepot by Amanda. These Terms & Conditions (“Terms”) govern your use of our services—whether placing orders through our website, contacting us directly, or engaging with our services in any way. By placing an order or using our services, you agree to be bound by these Terms.
1. Eligibility & Use
By placing an order you confirm that you are at least the age of majority in your state or territory, or you have obtained consent from a parent or guardian.
You agree not to use our products or services for any unlawful or unauthorized purpose.
2. Service Modifications & Pricing
Prices, menu items, and services are subject to change without prior notice.
We reserve the right to modify or discontinue any product or service at any time. We are not liable for any losses resulting from modifications, price changes, or discontinuation.
3. Product Descriptions & Allergens
We strive for accurate product descriptions, but variations in appearance or allergens may occur.
Our products are made in a kitchen that handles common allergens (e.g., peanuts, tree nuts, dairy, eggs, sesame, soy, wheat, etc.). We do not guarantee allergen-free products.
4. Orders, Payment & Cancellation
Orders are not confirmed until payment is received.
We reserve the right to refuse or cancel orders at our discretion, including those that appear fraudulent or exceed order limits.
In the event of a cancellation, we will notify you and provide a full refund or discuss alternatives.
5. Delivery or Pickup
Delivery or pickup details must be provided accurately.
We are not responsible for delays or issues caused by third-party delivery services.
Please check your order upon receipt; any issues must be reported within 24 hours.
6. Refunds & Exchanges
Due to the perishable nature of our products, refunds or exchanges are offered only if the product is significantly damaged or incorrect.
Requests must include photos and be submitted within 24 hours of delivery or pickup. Refunds will be determined on a case-by-case basis.
7. Hygiene & Handling
Cakes and baked goods may include non-edible supports or decorations (e.g., wooden dowels, wires, figurines). You are responsible for removing them before serving.
We do not assume liability for injuries or damage resulting from misuse or failure to remove supports.
8. Custom Designs & Inspiration
Designs are inspired by customers’ ideas but are not exact replicas of existing works. They will be adapted with unique touches.
A preliminary sketch or design concept may be provided after payment confirmation for approval prior to finalizing the order.
9. Liability & Disclaimers
All products and services are provided “as is,” with no guarantees or warranties.
Sugardepot by Amanda is not liable for any indirect, incidental, or consequential damages arising from your purchase or use of our products.
10. Indemnification
You agree to indemnify and hold harmless Sugardepot by Amanda from any claims arising from your use of our products, violation of these Terms, or infringement of third-party rights.
11. Severability & Termination
If any part of these Terms is deemed invalid or unenforceable, that part is severed, and the rest remains in effect.
We may terminate or suspend service at our discretion, and any obligations or liabilities that arose prior to termination will survive.
12. Governing Law
These Terms are governed by the laws of Australia (“Victoria, Australia,” if you wish to be more specific). Any disputes will be resolved under that jurisdiction.
